What are Gamba Migration’s response times? Our response times are approximately 3 to 5 business days.

What method of communication do we use? For security and better service we prefer the use of e-mail for sending and receiving documents and information.

Use of Whatsapp or SMS Sending information, documents or other information relevant to a process sent by Whatsapp or SMS messages will not be taken into account. However, all of our consultants have a number where you can call or send a message to be contacted.

Is Jorge Gamba in charge of my visa or process? No, Jorge Gamba is our immigration agent, who will guide you in your immigration process, but your process will be in charge of our education or migration teams who have great knowledge and experience to guide you through the process.

What should I do if I have a complaint? At Gamba Migration we always want to provide the best service, however if you have a feedback or complaint you can escalate it in the Complaints and Grievances form on our website.

Do I have to pay for my process or visa? Yes, each process has a charge depending on your case, the consultant will provide you with the cost of your process. Please note that you will also have to pay the fee for each entity or visa process with the Home Affairs department.

How can I pay for my process? If you are within Australia, the best way is to make a bank transfer to our business account, however we also accept credit or debit cards (remember that this generates an additional charge that you must assume). If you are outside of Australia, we have several alternatives, which our advisors will inform you about during the process.

What are my points of contact during my process? You will have an advisor assigned to your process who will accompany you along the way, as well as a processing team that will assist you in the collection of documents. In addition, there will be a manager who will oversee all processes.


How many residencies are awarded per year in Australia? According to national planning levels, in the fiscal year beginning July 1, 2023 and ending June 30, 2024, 190,000 permanent residencies will be granted. Source

How many international students are there in Australia? According to the Australian Department of Education, there were an estimated 710,000 international students in Australia as of July 2023. Source

How many people are in Australia on temporary visas? Between international students and holders of working vacation visa, covid visa, graduate visa and special work visas there are an estimated 1,000,000 people on temporary visas in Australia.

What is the difference between a study agent, an immigration agent and an immigration attorney? Study agents help put together a curriculum and quote courses but are not regulated under any legal regime. Migration agents must be registered with the MARA office and are subject to code of conduct requirements. They help validate your profession, apply for permanent residency and appeal denials. Immigration attorneys do the same as immigration agents and also assist in appealing visa denials in Federal Court.

Where can I check to see if an agent is registered with the MARA office? You can search the MARA’s website: Register of Migration Agents

Do I have to use an immigration agent or attorney to apply for residency? All visas in the Australian immigration system are designed so that anyone can apply for them with or without the assistance of an immigration officer.

How long are my medical exams valid? The medical exams will be valid for 12 months, if this time has passed you will have to submit new exams.


Is there an age limit to study in Australia? There is no age limit to study in Australia but the older you are, the more effort you will have to make to justify your genuineness as a student.

Can I include my family in the study visa? You can include your partner (married, cohabiting for more than 12 months, or in a registered relationship in an Australian state) and your children under 18 years of age.

Can I change schools during my study visa? It is possible but normally you must obtain a release letter from your current school before another school can offer you another enrollment.

Can I extend my study visa without leaving Australia? You do not have to leave Australia to “extend” your student visa. Extension” refers to applying for a new study visa before the current one expires.

What kind of courses can I study in Australia other than English? Vocational Education and Training (VET) and Higher Education (HE) courses.

Can I apply for residency while on a study visa? Yes, it is possible, but it will depend largely on the state where you apply.

If I have children in Australia on a study visa, what nationality do they receive? In Australia your children inherit your nationality and your visa. You will need to add them to your visa once you receive your passport.


What is the postgraduate visa (the 485)? It is a work visa that allows people who studied for at least 2 years in Australia to stay in Australia for a defined period of time after their studies.

What are the requirements to apply for a postgraduate visa? Study CRICOS-registered courses for at least 92 weeks, have a current English language test and required score, obtain an Australian judicial record (AFP check), and purchase OVC health insurance.

Is there a time limit to apply for a postgraduate visa? You must apply within 6 months after the institute terminated your studies or you had an active study visa.

Can I leave the country during my postgraduate visa? Yes, you can enter and leave Australia as many times as you wish.

Can I include my family while I am already on the postgraduate visa? Yes, you can include your partner and your children under 18 years of age.

Can I be denied a post-graduate visa? Yes, no visa application is 100% guaranteed and all have their own level of risk.


What is validation? It is a recognition of your professional and academic skills by a body authorized by the Australian government.

Can I apply for residency without validating my degree? It is only possible to apply for residency without validating your career if you apply for a 186 visa through the transition channel (TRT), a partner visa with an Australian resident or citizen, a refugee visa, or an investment visa.

How long can the validation process take? The time may vary depending on whether you have your documents ready. Please note that many entities may request financial documents, employment letters, English scores, etc. For this reason, harvesting and preparation could take from 1 to 4 months approximately.

How long will it take for me to receive an answer about my skills assessment? Each skills assessment entity manages a different time frame, however the times may vary between 3 to 6 months.


What is labor sponsorship? It is a system that allows Australian companies to hire qualified workers to fill vacancies on their payroll.

Where can I see the list of trades eligible for sponsorship for each visa? List of visa-sponsorable occupations in the 482 visa: Visa 482 occupations List of visa-sponsorable occupations in the 186 visa: Visa 186 occupations List of visa-sponsorable occupations in the 494 visa: Visa 494 occupations

How much experience am I required to have before I can accept a job sponsorship? If the sponsorship will be for an aged or disabled carer, they do not ask for experience, only a Certificate III in individual support. For visa 482 (temporary), 2 years of full time pre- or post-degree experience + the relevant degree. For visa 494 or 186, 3 years of full time post degree experience.

How do I check the experience required to accept a sponsor? With labor certification (reference letter) from the companies and evidence of payment such as pay slips, bank statements, pension fund contributions or tax returns.

How much experience do you require to enter the 482 temporary visa if I do not have the relevant degree? You must have at least two years of verifiable experience ideally within the last 5 years.

How do I know if a company can sponsor me? Ask yourself if this company has sponsored someone in your trade before and if it makes sense for you to be the first person sponsored in your trade.

What requirements must the company (the sponsor) meet? Accountants: companies with revenues over $1M AUD. Chefs: full menu restaurants only. Consultants: minimum salary of $90,000 + super per year. Depending on the context of the company and the occupation, conditions may vary.

How much can it cost to manage a labor sponsorship? Between $3,150 – $15,000 depending on the company’s income and the duration of the visa.

What is the minimum salary I should be paid on a sponsorship visa? The minimum salary on a sponsorship visa is $73,150 + pension (super).

Can I change employers if I am on a 482 work visa? Yes, as long as your new employer is prepared to transfer the nomination to the company’s name and cover the costs of such management.

If I get the 186 visa, can I change employers the next day? In theory yes, because you are already a permanent resident, but if you do not meet the minimum term of 2 years with the employer, there is a remote possibility of cancellation.

What happens if I am laid off or the sponsoring company goes bankrupt? You have 60 calendar days to find another company willing to sponsor you or you could apply for a study visa.

What is DAMA (Designated Area Migration Agreements)? It is a permit that some regional areas have to sponsor foreigners in lower level professions, with lower English, salary and age requirements.

What are the benefits of applying for a sponsorship visa under one of the DAMAs? Access to a higher age limit than normally allowed on 186 and 494 visas, access to a broader list of occupations, lower English language or minimum wage requirements.


What is the point system? It is a competition for one of the federal, state or regional invitations to residency.

How many points do I need to receive an invitation to the residency? In Victoria, Queensland, ACT and NSW, even with 90 points, you suffer. In South Australia, Western Australia, Tasmania and Northern Territory, with 65 points you have realistic chances.

Is it better to apply for residency by point system or by labor sponsorship? They are not mutually exclusive methods. You can apply for both and see which comes out first.

Can I change my status if I am a 190 or 491 visa guest? In theory yes, but it is recommended to stay in the state that invited you for 2 – 3 years after receiving the visa.

Can I apply for the 190 visa if I am already on the 491 visa? You cannot apply for 189, 190 or 186 visas for 3 years if you already have a 491 visa.

When can I apply for citizenship after becoming a resident? When you have spent 4 years in Australia and at least 1 of those 4 years has been as a permanent resident. You must also have been within Australia for 9 of the 12 months as a permanent resident.


How long should I live with my partner before applying for a partner visa? There is no minimum length of time, but it is recommended to live together for 3 – 6 months before entering the process.

What are the main requirements of the partner visa? Be married, registered, or have lived together in a conjugal state for at least 1 year. They must share life under the same roof, finances, social life and a mutual commitment.

What happens if my partner and I break up before I am granted residency? You would have to seek residency on your own unless you have a child together, suffer domestic violence, or the Australian partner dies.

My Australian partner previously gave a partner visa to someone else, do we have to wait some time? They must wait 5 years from the date of the previous application unless they have had a child or there are other compassionate circumstances.


What is the administrative court? The AAT reviews the decisions of administrative migration officials. This is the forum you go to if you receive a visa denial.

What will happen on the day of the court hearing? The tribunal member will speak with you directly and ask you the reasons why you believe you should be granted a visa.

What happens if I win in court? The application that was initially denied will be approved and the court will refund half of the fees you paid.

What happens if I lose in court? You can appeal to federal court or seek ministerial intervention in some cases.

If I was denied a visa and am awaiting a hearing? You cannot apply for another visa from Australia and you must win the appeal.


Can I get a residency if I studied business administration? Residency is by occupation, not by discipline. You must be seeking an occupation in administration and have at least 1 year of post degree experience.

I heard that studying nursing is one of the shortest paths to residency, is it worth it? Studying for a nursing degree can give you validation to apply for residency, but you need to obtain the necessary English score to enter study.

Can I come to the residence if I study child care? Post November 2019, the child care profession is now assessed by ACECQA, which requires 3 years of experience to validate child care center manager.

Can I come to the residence if I work in aged care? The aged or disabled carer trade does not have access to residency by point system, only by sponsor.

Why is studying the Advanced Diploma in Civil Design so popular today? Engineers Australia does not ask for experience or testing to validate. With the ADVANCED diploma in civil design you can submit an Expression of Interest to the residency.

Is studying community services still a good idea today? Yes, especially at the bachelor’s level. At the diploma level, they do not give you the postgraduate visa.

Why is Tasmania so popular today? Tasmania allows you to apply for residency for working in the state part time, studying for 1-2 years, setting up a business, or living in Tasmania for an extended period of time.

If I want residency in South Australia, what should I do? Live in the state for at least 12 months and work full time in a related profession for the last 6 of the 12 months.

What is the best city to look for a residence? It depends on your purposes, level of English and occupation. In major cities there is a greater likelihood of professional jobs and job sponsorship. In regional areas, the requirements are lower.
